- Develop and implement effective communication activities for external customers and stakeholders

-Assist the General Secretary and other NOBs with written correspondence as and when appropriate

The South African Medical Association Trade Union (SAMATU) is inviting qualified, experienced and reputable service providers to submit proposals for provision of regulatory external audit services.
INVITATION FOR PROPOSAL
Proposals are hereby invited from qualified and experienced contractors to provide external audit services for SAMATU. SAMATU’S Financial year runs from 1st January to December. The period to be audited will run over two financial years starting from April 2020 to December 2022.
SCOPE OF SERVICES
The SAMATU seeks to appoint a qualified service provider for the provision of external Regularity Audit Services. The appointed auditors will report to SAMATU General Secretary. The audit will be for 2020/2021/2022 Financial years. Proposals should clearly indicate the capability and experience in carrying out such services. Interested Audit firms are requested to submit tender documents for technical proposal and financial proposal.
The proposal should contain the following information:
- Organisational profile
- Proposed approach for audit work
- Details of relevant experience within the audit sector
- Audit improvement and value-add that could be offered to SAMATU
- Profile of senior staff such as audit partner. Must be registered with the Independent Regulatory Board for Auditors (IRBA). Audit Manager must be registered with CA (SA) as well as the auditors who would supply the services

NO CONTRACT
Bidders shall note that this RFP does not commit to any course of action resulting from the receipt

LABOUR RELATIONS OFFICER

JOB RESPONSIBILITIES
OPERATIONS:
- To provide expert advice and support to members and other key stakeholders on labour law and labour disputes daily
- To represent SAMATU members at grievance processes, disciplinary hearings, conciliations and arbitrations to ensure adherence to fair labour practice
- Refer dispute cases to the Bargaining councils and CCMA on behalf members
- Prepare documents and witnesses for grievance disciplinary conciliations and Arbitrations
- Appeal on behalf of members
- Develop effective relationships with relevant stakeholders to promote good employee relations across the organisation
- Ensure that all collective bargaining demands from members are consolidated, researched and submitted for negotiations

SAMATU desires a fully outsourced IT management vendor to provide SAMATU with information technology services in the areas of network analysis and technical support, systems support, computer operations support, PC desktop technical support, software integration support, telephone system support, and assistance with emerging technologies and accessories. The qualified vendor will enable SAMATU to significantly improve information technology (IT) effectiveness, enhance its quality of services, minimize its support cost and maximize return on IT investment.
INVITATION FOR PROPOSAL

SCOPE OF SERVICES
Supply of IT equipment
Purchase of basic equipment as required and advised by SAMATU

Server Administration Services
Manage computer network and associated hardware, software, communications, and operating system(s) necessary for the quality, security, performance, availability, recoverability, and reliability of the system. Monitor server performance and capacity management services. Ensure scheduled preventive maintenance for equipment is promptly performed.
Network Administration Services
Scope of network administration services includes all SAMATU network equipment including switches, firewalls, routers, IP phone system and other security systems. Manage backup and disaster recovery systems for server, e-mail, and telephone system. Information on these systems must be backed up in a secure fashion following industry standard and SAMATU must have access to the backed-up information. The scope also includes primary installation and maintenance of printers, group policies, software and system updates (Windows, Office 365, firewall, anti-virus, etc.) as deemed necessary. Monitor network performance and capacity management services.
Audio-Visual Equipment Support
SAMATU has a conference room with overhead projector and wired microphone sound system for identified Committee meetings.
Security
Maintenance of virus/malware detection and spam reduction programs on SAMATU servers, email, telephone system, and all SAMATU computers and laptops. Perform security audits as requested and notify SAMATU personnel immediately of suspected breaches of security. Assist SAMATU in complying with best practices.
Telephone System
Management and maintenance of the VoIP phone system, including server, switches, and phones. Ensure the voicemail to email function is working properly. Assist SAMATU personnel with technical support for the phone system.
Information Technology Strategic Planning
Provide technical leadership for all technology issues. Make recommendations for future purchasing and technology needs. Keep SAMATU up to date on new technology changes and uses that will enable.
SAMATU to increase efficiency and reduce costs. Install equipment including new servers, software, and hardware and transfer data when required. Assist with policy formulation and application.
Help Desk Support
End user support must be timely, friendly, and professional. Urgent and emergency support must be available 24/7/365. Routine support must be available Monday – Friday from 8:00 a.m. to 5:00 p.m. for SAMATU employees.
End User Training
Provide training for various technologies as needed. This would normally be for common software or hardware used in a business setting or new equipment installed. This can be at the request of SAMATU or when a need is identified by the vendor. This cost for trainings would SAMATU RFP 2020-001 Page 9 be negotiated per training and in addition to the on-going contract services.
Onsite Support
Provide regular scheduled and dedicated onsite support to address SAMATU hardware and software issues. Additional onsite support may be needed for major projects.
Computer Inventory and Disposal
Vendor must provide monthly hardware inventory reporting. Disposal of surplus electronic equipment must be coordinated with the Finance and Human Resources Section Manager and comply with SAMATU Board adopted policies.
Contract

REQUEST FOR PROPOSAL_PANEL OF ATTORNEYS

The South African Medical Association Trade Union (SAMATU) would like to invite suitable, qualified, and competent firms of attorneys to send proposals to be considered for inclusion on its panel of attorneys, as ‘preferred service providers’. Preferred service providers imply that the selected firms are a pool, not necessarily the only contracted service provider. The panel of attorneys will be required to provide legal services to SAMATU, on an ad hoc basis.
This RFP document details and incorporates, as far as possible, the tasks and responsibilities of the potential Service Provider(s) required by SAMATU. This RFP does not constitute an offer to do business with SAMATU, but merely serves as an invitation to bidders to facilitate a requirements-based decision process.
SAMATU may from time to time utilise the services of admitted Attorneys to provide legal services to SAMATU. These services may include
1. the provision of legal opinions to SAMATU
2. instituting or defending legal actions on behalf of SAMATU
3. Providing legal advice and counsel.
4. Researching and gathering information or evidence.
5. Drawing up legal documents as and when required.
6. Alternative dispute resolution
7. Provide training and development
8. To provide any general legal services to the union
9. Handling and/or presiding over grievances and disciplinary enquiries/matters of all employees.

APPOINTMENT TERMS
SAMATU does not guarantee that successful Bidders will receive work during their appointment term. Service Requests will be used on an ad hoc basis, as and when required by SAMATU. The principle of rotation to ensure equitable distribution will be applied and due diligence conducted to ensure that no conflict of interests exist prior to the allocation of work.
PROPOSAL REQUIREMENTS
· Each proposal must include brief history of the firm and outline the firm’s geographical structure
· list of clients for whom legal services were rendered on a regular basis in the past 3 (three) years (the most recently served clients must be mentioned first and specify the nature of all work done)
· The specialist fields of law of the firm and brief CVs of core service team that will be attending to SAMATU work with specific reference to their education/professional background and experience.
· If a firm of attorneys has expertise in more than one field of law, all relevant fields must be indicated in the proposal together with demonstrated experience in the specified areas of law.
· The hourly rate of each attorney must be included in the proposal.
The written tender application should focus on the following aspects in order to be considered
· Demonstration of the firm’s Legal experience including qualifications of the
· Director/s and the team to be assigned to the Commission.
· Specialized skills, expertise, and value-added services.
· Shareholding and Management structure.
· Submission of a Valid Fidelity Fund Certificate.
· Proof of current and valid Legal Practice Council Membership for the Director
of the Firm.
DURATION OF APPOINTMENT
The term of the contract commencement will be agreed upon with the successful service providers. SAMATU reserves the right to terminate the contract of the service provider on the basis of poor performance, giving the service provider at least one (1) month’ prior notice thereof in writing.
NEGOTIATING AND CONTRACTUAL OBLIGATIONS
A bid will constitute a binding offer, but such offer will be deemed not to have been accepted, unless and until a definitive contractual agreement (SLA) and other related documents are concluded between SAMATU and the preferred bidders, with or without further negotiation.
· SAMATU or its authorised representatives have the right to enter into negotiation with one (1) or more bidders regarding any terms and conditions, including price(s), of a proposed contract.
· SAMATU shall not be obliged to accept the lowest bid price.
· SAMATU reserves the right to select another Preferred Bidder in the event that negotiations with the originally selected Preferred Bidder prove unsuccessful and/or unduly delayed.
· Upon final selection and notification of the Preferred Bidder, a process of final negotiations will commence. Negotiations will be used to finalise outstanding elements of the SLA in an effort to arrive at a comprehensive binding SLA that will govern the relationship between SAMATU and the Successful Bidder.
· Under no circumstances will negotiation with any Bidders, including with preferred Bidders, constitute an award or promise/ undertaking to award the contract or be construed as legitimate expectations by such Bidder.
LABOUR LAW REQUIREMENTS (APPLICABLE TO ALL FIRMS WHO TENDERS FOR THE LABOUR LAW CATEGORY)
LABOUR LAW
The bidder must demonstrate relevant experience in providing legal advisory services in labour relations matters which may include the following:
Provision of general labour related advice, legal opinions or related services including but not limited to:
· Changing labour law employment legislation and its potential impact (e.g. BCEA, LRA and Employment Equity Act etc.)
· Represent the employer at arbitrations, mediations, the Labour Courts, and other administrative hearings.
· Handling grievance and, disciplinary and arbitration hearings.
· Workplace discipline and counselling
· Preside over disciplinary and grievance hearings and also act as initiators/prosecutors at hearings.
· Dealing with Dismissals for Misconduct. Incapacity and Operational requirements matter under Section 189.
Drafting of relevant labour related documentation including but not limited to:
· Employment contracts, disciplinary codes, grievance procedures and collective agreements.

SAMATU reserves the right to select the appropriate service provider(s) based on its requirements; and SAMATU may review its panel of law firms, add or remove any Bidder from the panel at any time before the expiry of the five (5) year period which the panel will be appointed.
CONTRACT TERMINATION
A contract/s with a successful Bidder/s may be terminated by SAMATU on the grounds of valid commercial or operational requirements that were not foreseen at the time of the Request for Bid
being submitted and the contract being entered into. SAMATU, if it wishes to terminate the contract, shall be required to give 30 (thirty) days written notice of its intention to terminate the contract.
Such notice must be preceded by bona fide discussion between SAMATU and the successful Bidders. In this instance SAMATU shall only remain liable for all amounts due to the successful Bidders with respect to the period ending on the date of the cancellation and shall not be held liable for any damages or losses on the basis of such a termination of the contract.

REQUEST FOR PROPOSAL_CONSTITUTION AND POLICY DEVELOPMENT

The South African Medical Association Trade Union (SAMATU) would like to invite suitable, qualified, and competent firms of attorneys to send proposals for the development of policies and the constitution of SAMATU.
This RFP document details and incorporates, as far as possible, the tasks and responsibilities of the potential Service Provider required by SAMATU. This RFP does not constitute an offer to do business with SAMATU, but merely serves as an invitation to bidders to facilitate a requirements-based decision process based on a project (development of policies and constitution).
PROPOSAL REQUIREMENTS
· Each proposal must include brief history of the firm and outline the firm’s geographical structure
List of clients for whom legal services were rendered on a regular basis in the past 3 (three) years (the most recently served clients must be mentioned first and specify the nature of all work done)
The specialist fields of law of the firm and brief CVs of core service team that will be attending to SAMATU work with specific reference to their education/professional background and experience.
If a firm of attorneys has expertise in more than one field of law, all relevant fields must be indicated but emphasis should be placed on the work that is required as per the request for proposal.
The hourly rate of each attorney must be included in the proposal.
The written request for proposal should focus on the following aspects in order to be considered
Demonstration of the firm’s Legal experience including qualifications of the
Director/s and the team to be assigned to the Commission
Specialized skills, expertise, and value-added services
Shareholding and Management structure
Submission of a Valid Fidelity Fund Certificate
Proof of current and valid Legal Practice Council Membership for the Director of the Firm.
NEGOTIATING AND CONTRACTUAL OBLIGATIONS
A bid will constitute a binding offer, but such offer will be deemed not to have been accepted, unless and until a definitive contractual agreement (SLA) and other related documents are concluded between SAMATU and the preferred bidders, with or without further negotiation.
SAMATU or its authorised representatives have the right to enter into negotiation with one (1) or more bidders regarding any terms and conditions, including price(s), of a proposed contract
SAMATU shall not be obliged to accept the lowest bid price
SAMATU reserves the right to select another Preferred Bidder in the event that negotiations with the originally selected Preferred Bidder prove unsuccessful and/or unduly delayed.
Upon final selection and notification of the Preferred Bidder, a process of final negotiations will commence. Negotiations will be used to finalise outstanding elements of the SLA in an effort to arrive at a comprehensive binding SLA that will govern the relationship between SAMATU and the Successful Bidder.
Under no circumstances will negotiation with any Bidders, including with preferred Bidders, constitute an award or promise/ undertaking to award the contract or be construed as legitimate expectations by such Bidder.
LABOUR LAW REQUIREMENTS
The service provider must demonstrate relevant experience in providing legal advisory services in labour relations matters which must include the following:
Provision of general labour related advice, legal opinions or related services including but not limited to:
· Changing labour law employment legislation and its potential impact (e.g. BCEA, LRA and Employment Equity Act etc.)
· Understanding of the legal framework regulating trade unions
· Understanding of policy development and implementation
· Extensive experience in working with trade unions

REPORTING
The appointed service provider will be expected to report on a weekly basis to a committee that id overseeing the project, and such shall take place until the project is successfully completed.

-Curate the SAMATU Customer Relationship Management (CRM) system
-Ensure that new membership applications are processed accurately and timeously
-Ascertain the integrity of the member data, by updating and making efforts to obtain current data from members with missing data on the CRM
-Ensure the safekeeping of members data, in line with the Protection of Personal Information Act
